Prerequisites

Objectives and Contextualisation

- Introduction to the concept of European citizenship, and delve into its content and derived rights. Distinguish between rights derived from citizenship and the legal status and rights of persons without such status.

 - To provide the tools to understand the basis of the legal architecture of the European internal market, namely the rules of the freedoms of movement (in particular, the movement of persons and goods, as well as the rights of establishment and the right to provide services) and the EU's policy on market competition.

 - Introduction to the foundations and concepts of the Area of Freedom, Security and Justice: immigration and borders, judicial and police cooperation in criminal matters, and judicial cooperation in civil matters.

 - Familiarization with the criteria used by the Court of Justice of the European Union to decide on the compatibility or otherwise of the measures of the Member States with the EU Law on free movement.

 - To facilitate that students acquire the necessary tools to work on specific cases related to this subject.

- To train students to be able to deep on the specific topics of the program, for example through the completion of a Master Final Project.


Competences

  • Identify and resolve conflicts of competence between the EU legal system and national systems (specialisation in Legal Integration ).
  • Identify citizens' rights established in the EU legal system and know the legal procedures for their protection (specialisation in Legal Integration).
  • Integrate knowledge and use it to make judgements in complex situations, with incomplete information, while keeping in mind social and ethical responsibilities.
  • Seek out information in the scientific literature using appropriate channels, and use this information to formulate and contextualise a research topic.

Content

- From the EEC to the EU. Evolution of integration. Principles and values. The internal market, concept and content. The Area of Freedom, Security and Justice.

- Citizenship of the Union. Concept, content and effects. Relationship with nationality. The role of the CJEU in its definition and regulation.

- Free movement of persons in the EU. Citizenship, mobility and right of residence.

- The EU and natural persons who are nationals of third countries: entry, residence and mobility regimes in the EU.

- Fundamental freedoms and the internal market: free movement of goods, freedom to provide services, right of establishment, free movement of workers and free movement of capital.

- Company law in the European Union.

- European Union competition policy.

- Judicial and police cooperation in criminal matters. Judicial cooperation in civil matters

- Conferences or seminars that may be organised during the course.

The educational progress is organized from three different types of activities:

 1. Professor directed activities

These activities are developed in the classroom during a semester, within the timetables foreseen for the module and under the direction of the teaching staff. They may be theoretical or practical, but this distinction between theoretical and practical activities is not a rigid division, because both aspects are always integrated in the courses. Although it is not approximate, we can calculate that 75% of the teaching would be devoted to theoretical aspects, and 25% to practical aspects. Attendance to classes is compulsory.

1.1. Theoretical aspects

The theoretical classes are based on the teacher's exposition of the corresponding subjects of the programme. The active participation of the students is expected and a dynamic interrelation between teacher and students is required.

1.2. Practical aspects:

The practical part of the sessions will be mainly devoted to the analysis of the case law of the Court of Justice of the European Union and the resolution of practical cases, based on the legal provisions and their interpretation by the Court of Justice. Normally, this practical part will be developed orally, although students may also be asked to resolve written practices.

The materials for the practices will be placed in the virtual campus or they will have to be looked for by the students, through the electronic resources and the available data bases, or using the available collections in the library of social sciences of the UAB and in the library of the European Documentation Center, located in the UAB campus.

1.3. Complementary seminars and/or conferences:

In addtition to the courses scheduled, specialized seminars or conferences could be offfered during the course.

 2. Supervised activities:

Students are the responsibles for these activities, always supervised and under the direction of their professors. During the couse, three sessions will be devoted to carrying out supervised activities, which will be done in writing, and in principle in the classroom. The result of these activities will be used to decide the evaluation of the module, as will be explained in the corresponding section.These activities may consist of preparing a dissertation, answering questions about theoretical aspects, solving case studies or commenting on a text or document. They may also consist of personal working, following the instructions provided by the teaching staff

3.Autonomous activities (individually or in group):

Study of the bibliography and materials; Students will have to find the materials required for the preparation of the course and the evaluation tests.

Annotation: Within the schedule set by the centre or degree programme, 15 minutes of one class will be reserved for students to evaluate their lecturers and their courses or modules through questionnaires.

The assessment system is continuous assessment, based on activities that each teacher will schedule and inform students of in advance. These activities may consist of oral or written dissertations, group work, reading and commenting on regulatory texts and judgements, multiple-choice tests, debates, etc. Some of these activities may be common to different thematic blocks of the programme.

90% of the module grade will be obtained from the arithmetic mean of the grades obtained in the continuous assessment.

The remaining 10% will be obtained depending the attendance and participation in the conferences or complementary seminars organized.

To determine the final grade, the resulting average grade may be subject to weighting taking into account an overall assessment of the results achieved by the student.
