Objectives and Contextualisation

The focus of this subject is to be a reflection of the primordial objectives of the Degree.

The students must apply their knowledge, both theoretical and normative, to the management

of the Private Security world, which is composed of security companies and private security personal, being able to distinguish the different types of services that can be provided to the users, either public or private, and the functions and thresholds of the personal attributions that depend on the different professional categories.

This will be the foundation from which the student will acquire the necessary knowledge so that quality propositions can be created from within the private security; taking into consideration the law and the normative frame, and the consumer requirements regarding private security.

-Comprehend the foundations for the provisioning of private security services.

-Acquire knowledge of private security legislation.

-Be able to identify the functions belonging to the State Security Forces and the activities and services that are being, in a complementary and subordinated way, assigned to the private security forces.

-Be competent in regards with the theoretical contents and the normative frame so that coordination between professionals and technicians of this field can be achieved.

-Achieve linked knowledge with the other subjects of the Degree.

Content

1. Security: as the right of people and as an essential public service.

2. Legal Framework of Public Safety: Organic Law 2/86 of FCS and Organic Law 4/2015, on the protection of citizen security.

3. The Spanish police model: FCS and its competencies. FCSE (National Police and Civil Guard Corps). Autonomic and Local Policies.

4. Concept of private security. Private security activities and services. Coordination and collaboration with FCS.

5. Legal Framework for Private Security: Law 5/2014 and its regulatory development.

6. Private security activities: material scope of private security service providers (companies and security professionals). The so-called compatible activities.

7. Prior authorization and intervention of the State. Authorization procedure. The so-called Responsible Declaration. Competences of the State and of the Autonomous Communities.

8. Formal and material requirements, and personal, to authorize a security company. State companies and autonomous companies.

9. The National Registry of Private Security. Registration and cancellation of companies. The Autonomous Registries.

10. General and specific obligations of security companies. Prohibitions

11. The security personnel: qualification and categories. The Private Detective and the Administration: obtaining of the qualification, identity card and book-registry.

Registration in the Registry of the General Directorate of the Police or in the Autonomous Registry. Functions of the Private Detective. Statute (rights and duties) of the Private Detective. The Detention ceased.

12. General obligations of security personnel: Duty Assistance and collaboration with the FCS. The principles of action (Code deontological). Sanctioning Regime. Violations of regulations in the field of private security.

13. Private research. The Private Detective in modern society. The professional performance of the Private Detective in relation to the needs of modern societies. Private Self Detective, Agencies, Delegations and Branches. Requirements. Professional honors: applicable deontological criteria. The ethical requirement of a previous budget. Applicable legal regulation and its relation to the ethical norms.

14. The search for crimes by private detectives. Criminal investigation authorized by Private Detectives. The condition of "legitimized" for the exercise of criminal action (Art. 48.1 c) LSP.

15. Special consideration of the intervention of the DP in the civil process. Articles 265 1.5. and 380 LEC. The DP as a collaborator of the Justice Administration. Legal status of the DP. Special analysis of the differences between witness and expert. The figure of the witness-expert.

16. Responsibility of the DP: criminal and / or civil. Analysis of the disciplinary system: causes and jurisprudential doctrine. Common assumptions investigated by the DP: frauds in IT, unfair competition, non-attendance, abandonment of work day and low performance, damages to the company and its employees.

17. Specific functions of the different categories of security personnel: Special reference to the Chiefs and Directors of Security.

18. The Departments of Security: Creation and functions. Security measures and forced establishments. The so-called critical infrastructures. UNE-EN Standards and Quality Certificates in the field of private security.

Methodology

As indicated in the contextualization of the subject, "Private Security Law" has a theoretical aspect and a practical aspect. The theoretical aspect is learned through the study of materials. The practical aspect of the subject is developed through exercises that will be done individually but where a Forum of doubts and debates will be created.

The course has a MOODLE page open in the Virtual Campus where you will find the subject materials, news and instructions for the subject and the system to do the delivery of work, among other applications.

To access, you must enter the UAB Virtual Campus, whose address is: https://cv.uab.cat/. You have to enter with the University Identification Number (NIU) and password (password) that is provided in the registration process.

The Virtual Campus is also the main communication tool of the students with the teacher, both at the level of doubts, and communication of possible problems in the development of the subject. When a student wants to get in touch with a teacher, they will use the Moodle classroom messaging in preference to the use of email.
For each of the PECs a forum will be opened for questions and debates where participation is key to answering questions or expanding knowledge and sharing them.
Tutorials with the faculty will be arranged by email.

Assessment

The evaluation system will follow the model of "continuous evaluation" and will consist of the realization of 2 exercises and a final test.
Evidence of continuous evaluation (60%) (PEC1 and PEC2)
It will consist of the realization of two practical exercises on the subjects of the subject related to the content of the subject. Its realization will be carried out, based on the student's manual and can be complemented with documentation of the basic bibliography or with a reference reference that will be cited in the exercises.

  • Presential examination (30%) (individual test). It will consist of carrying out a test to be done in person at the School.
  • Online Exam (10%) (individual test). It will consist of carrying out a test to be done through the moodle of the subject.

If you do not pass the subject in accordance with the aforementioned criteria (continuous evaluation), you can do a recovery test on the scheduled date in the schedule, which will cover all the contents of the program.
To participate in the recovery students must have been previously evaluated in a set of activities, the weight of which is equivalent to a minimum of two thirds of the total grade of the subject. However, the qualification that will appear on the student's file is of a maximum of 5-Approved.
Students who need to change an evaluation date must submit the request by filling in the document that will be found in the EPSI Tutorials Moodle space.
